a. Client Data Use
Business Actualization ("Consultant") collects and stores information provided by the Client in the course of delivering Services. This includes but is not limited to business information, marketing performance data, and project-specific insights.
Client data is used to:
Operate, manage, and improve service delivery;
Benchmark marketing and business performance across the Consultant’s portfolio;
Generate internal reports, insights, and recommendations;
Share anonymized aggregate data for educational or marketing purposes (e.g., performance trends, best practices).
All benchmarking or sharing of Client data is done anonymously and without attribution to the Client unless written permission is provided.
b. End Customer Data Use
In the course of delivering marketing and technology services on behalf of the Client, Consultant may collect or handle limited information about the Client’s end customers, including but not limited to names, emails, phone numbers, IP addresses, and behavioral or engagement data.
End customer data is used solely to:
Execute and optimize marketing campaigns (e.g., digital ads, email automation);
Track conversions and campaign attribution;
Analyze customer engagement;
Improve marketing effectiveness on behalf of the Client.
Consultant stores this data securely using commercially reasonable administrative, technical, and physical safeguards. End customer data may be shared with third-party technology partners (such as advertising platforms or analytics tools) only as necessary to fulfill the Services described in this agreement, and only to the extent such third-party partners have adopted
similarly commercially reasonable safeguards to protect such end customer data. Consultant does not sell, lease, or share end customer data for any independent commercial purposes.
c. Data Security and Compliance
Consultant employs industry-standard practices to protect all collected data from unauthorized access, loss, or misuse. These include secure storage systems, access restrictions, and partner compliance standards. While Consultant is not a data processor under formal privacy legislation (e.g., GDPR, CCPA) unless otherwise agreed in writing, it endeavors to comply with best practices relevant to data minimization, purpose limitation, and secure handling.
Client Data Collection and Management
1. What We Collect
a. Publicly Available Data. We may collect basic business information that is publicly accessible—such as a shop’s name, address, phone number, website URL, and list of services—without any additional permissions.
